1. What Does manyactive Do?

manyactive is a community-driven social fitness platform thoughtfully designed for communities, businesses and teams. Connecting users to fitness and wellness services, including tools to track performance and manage your business. Services or products offered are operated by platform members or other third parties through our platform. manyactive App Ltd., is headquartered in Kenya. manyactive App operates all around the world.

2. What Personal Information Does manyactive Collect?

We collect or receive personal information in a few different ways via the Site. Often, you choose what information to provide, but sometimes we require certain information in order for you to use, and for us to provide you with, the Site and the experiences you reserve or access through the Site.

Data You Provide To Us

There are a variety of different ways you may provide data to us, such as:

Account Creation. To create an account, you need to provide data including information such as your name, email address, phone number and a password. If you make a purchase or sign up for a subscription, you will need to provide payment and billing information.
Profile. To complete your profile, you may provide other information, such as a photo or birthdate.
Posting and Uploading. We collect personal information from you when you provide, post or upload it to our Site, such as when you respond to a survey or provide a Session rating or review.
Third Party Data. You may not provide information to us about someone else unless you have obtained the prior consent of the other person for us to receive and use their information, such as for emergency contact or referral purposes.
User PhoneBook Contacts. manyactive reads the user's phonebook contact information, provided that the user grants this permission, to help suggest friends these users can follow on manyactive, and also help invite non-existing contacts to manyactive. manyactive does not use this information for anything other than this.
Health Data and Privacy. manyactive utilizes the Health Connect/Google Fit APIs to access your health data. We are committed to protecting your privacy and adhering to Google Play Store policies for handling sensitive data.
- We only access and use your health data to provide the core functionalities and features of our application (explain what functionalities here).
- Your health data will not be used for any other purposes, including advertising, data brokerage, or information reselling.
- We do not share your health data with any third-party. We only share challenge-related health metrics among challenge participants. These metrics are limited to steps, distance covered, and calories burned, scoped to the challenge and visible only to challenge participants in the app.

Data Collected Automatically Through Your Use of the Site.

We log usage data when you visit or otherwise use our Site, such as when you view or click on content or ads (on or off our Site), perform a search, browse, schedule a reservation and install or update one of our mobile apps. Specifically, the information we collect automatically may include information like internet protocol ("IP") address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information. We may also collect information about how your device has interacted with our Site, including the pages accessed and links clicked.
We may also collect precise geolocation data pertaining to your mobile device, if you have consented to providing this to us through your device settings. We may use this information to provide, promote, and improve our services (for example, by showing you sessions that are close to your location) and for related reasons, such as fraud prevention and security purposes. Please note that if you do not consent to providing your geolocation data, certain features of the mobile application may not work.

The information we collect automatically enables us to better understand the visitors who come to our Site, where they come from, and what content on our Site is of interest to them. This enables us to improve the quality and relevance of our Site to our visitors.

Cookies, Web Beacons and Other Similar Technologies.

We use cookies and similar technologies (e.g., web beacons, pixels, ad tags and device identifiers) to recognize you and/or your device(s) on, off and across the Site, including when you use different devices. Data From Others

From time to time, we may receive personal information about you from third party sources to assist us in providing, evaluating and improving our Site and offerings, but only where these third parties represented either that you gave your consent or are otherwise legally permitted or required to disclose your personal information to us. For example, studio partners may provide information to us in connection with a reservation you make or a Session that you take if there is an issue with your reservation. We may also collect information from third-party services like Facebook if you use one of these services to log into or integrate with our Site. This information may include your name, email address, gender, city, and state or your friends or contacts on such sites. Logging in through these third-party services may allow you to interact with other users that maintain accounts through those services. Further, if you choose to integrate your manyactive account with your AppleHealth, GoogleFit/Health Connect or similar application, we may receive certain sensitive personal information such as your steps, distance covered, calories, activity time to help track your activity, personalize your experience and improve our service.

Personal data also includes your:

contact details including name, email, telephone number and shipping and
billing address;
login and account information, including screen name, password and unique user ID;
personal details including gender, hometown, date of birth and purchase history;
payment or credit card information;
images, photos and videos;
data on physical characteristics, including weight, height, and body measurements (such as estimated stride and shoe/foot measurement or apparel size);
fitness activity data provided by you or generated through our Platform (time, duration, distance, location, calorie count, pace/stride); or
personal preferences including your wish list as well as marketing and cookie preferences.

We collect additional personal data from you to enable particular features within our Platform. For example, we request access to your phone’s location data to provide services local to you, your contacts to allow you to interact with your friends, your calendar to schedule a training plan or your social network credentials to post content from our Platform to a social network. This personal data includes your:

movement data from your device's accelerometer;
photos, audio, contacts and calendar information;
sensor data, including heart rate and (GPS) location data; or
social network information, including credentials and any information from your public posts about manyactive or your communications with us.

When interacting with our Platform, certain data is automatically collected from your device or web browser. More information about these practices is included in the “Cookies and Pixel Tags” section of this privacy policy below. This data includes:

Device IDs, call state, network access, storage information and battery information.
Cookies, IP addresses, referrer headers, data identifying your web browser and version, web beacons, tags and interactions with our Platform.

3. What Does manyactive Do with the Personal Information it Collects?

manyactive uses personal information it receives for several purposes:

Site: To operate and maintain our Site and the products and services offered through our Site. For example, we use personal information to fulfill your reservation and purchase requests, including processing payments, and to customize your experience on our Site, such as by tailoring the content or experiences we show you

Communication: To contact you through email, phone, postal mail, notices posted on our websites or apps, and other ways. We will send you messages about the availability of our Site, security, customer service, or other service-related issues. We also send messages about the Site, updates, reminders, and promotional messages in accordance with your communications preferences. You may change your communication preferences at any time. Customer Support: In connection with customer service inquiries and matters, such as to investigate, respond to and resolve complaints and service issues.

Marketing: For marketing purposes which are conducted within the app only, such as to develop our marketing strategy and offer contests, sweepstakes, or other promotions and to fulfill any related awards or discounts, we may use basic information such as location, age, sex, and activities on the app. We do not include health data activities obtained from Health Connect/Google Fit or any other metrics retrieved from the user's device in our in-app marketing activities. We may use the information that you provide to us, as well as information from other products or services, such as your interactions with our app, to personalize communications on products and services that may be of interest to you within the app. In doing so, we may combine the information you provide to us with information that we create about your online activity, including internal insights and analysis.

Research and Development: For research, analytical, recordkeeping, and reporting purposes; to develop and test new products, features and ideas; to learn about our customer base and Site and to evolve and improve our Site, products and services.

Fraud-Prevention, Security, and Investigations: We use your information to maintain the security of our Site, including to verify your identity and account, to investigate or prevent possible fraud, trial abuse (for example, running pre-authorizations), and/or other violations of our Terms of Use or this Privacy Notice and/or in connection with possible attempts to harm our members, visitors, studio partners or other third parties.

Cookies: We also allow third parties (such as advertising networks) to collect personal information about you through our Site for online behavioral advertising purposes. For further information, please see our Cookie Notice.

Legal Grounds: To process your personal data, we rely on certain legal grounds, depending on how you interact with our Platform.

When you purchase products from our Platform, we need your personal data to fulfill our contract with you. For example, we need your payment and contact details to book your sessions.
When you use our App, we rely on your consent for processing and for certain limited purposes to fulfill our contract with you (for example, for in-App purchases).
We also rely on other legal grounds, such as our legitimate interests as a business to process information about the effectiveness of our marketing campaigns, our products, services, events and other promotional initiatives; to operate, improve and maintain our business, products and services; to protect our or others' rights, property or safety; and for general research and analysis purposes. When processing personal data for our legitimate interests, we take appropriate measures to ensure that the interests we pursue are balanced with your interests, rights and freedoms, which we are happy to explain upon request.
We also process your personal data to comply with a legal obligation, or to protect your vital interests.

Other Purposes: We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent where necessary.
We do not sell or rent your personal information to other businesses or third parties for monetary or other valuable consideration.

4. Who Does manyactive Share My Personal Information With?

We may disclose your personal information to the following categories of recipients or in the following circumstances:

Third party services providers and partners who provide data processing and other services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our Site, payment card processors, customer support vendors, hosting vendors, scheduling providers and market research and marketing vendors), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information;
To our group companies, to provide, develop, improve, and analyze the Site and our offerings;
Where you direct us to disclose your personal information to a venue, studio, instructor or other provider that makes available a Session, activity or experience which you reserve or use through our Site and their third-party providers, so that they can process the applicable reservation or activity and make available the Session, activity or experience to you;
To anyone who visits our Site if you voluntarily share information about yourself in a public area on our Site, such as a public profile or Session ratings. You should be aware that any content or information you choose to disclose in these areas can be read, collected and used by other users, the general public and other sites (including search engines);
manyactive may allow you to access a variety of audio or video digital sessions from your computer or mobile device, via live stream and/or on demand. When you participate in these digital sessions through a connected device, such as a heart rate monitor, we may collect heart rate and other metrics to calculate your ranking in the leaderboard, display a record of your participation and otherwise provide, learn about and improve the Site and our services. If you sync your heart rate monitor with the Site to participate in digital sessions, you will automatically be part of the leaderboard experience, and other participants in the Session will see your profile information (including your profile picture and username) and rank in the Session. In addition, we may display this information or your rank on our Site, for example to display that you were a top participant that week. If you do not want your profile information to be seen by other manyactive users, do not include any identifying information;
To any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary as a matter of applicable law or regulation, to exercise, establish or defend our legal rights, or to protect your vital interests or those of any other person;
In connection with an actual or potential merger, sale, acquisition, investment, assignment, reorganization, joint venture, or transfer of all or part of manyactive’ business, assets, affiliates, including if manyactive should ever file for bankruptcy or a related proceeding, provided that we inform the relevant third party it must use your personal information only for the purposes disclosed in this Privacy Notice;
To your employer (or similar entities), if you participate in any enterprise solutions or corporate programs; and
To any other person with your consent to the disclosure.

5. How does manyactive Keep My Personal Information Secure?

We use reasonable security procedures and practices appropriate to the nature of the information to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. We monitor our systems for possible vulnerabilities and attacks. However, we cannot guarantee 100% security of any information that you send us.

You have the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (portability) and to have this information transmitted to another company; (iii) correction of your personal data if it is incomplete or inaccurate; or (iv) deletion or restriction of your personal data in certain circumstances provided by applicable law. These rights are not absolute. Where we have obtained your consent for the processing of your personal data, you have the right to withdraw your consent at any time.

Please be aware that manyactive does not control these linked websites or apps and that this Privacy Notice does not apply to any information you give to the owner of these websites or apps.
